(a) Welcome to journeychinese.com.au (the “Website”). The Website provides our Online Mandarin School, Tutoring Services, Travel Guides and related content (the “Services”).
(b) The Website is operated by Nicolson Pty Ltd (ABN 936 836 994 16) trading as Journey Chinese (“Journey Chinese”, “we”, “us” or “our”).
Access to and use of the Website and Services is provided by Journey Chinese. By using, browsing, or reading the Website, you agree that you have read, understood and accepted these Terms of Service (“Terms”).
If you do not agree, you must immediately stop using the Website and Services.
(c) Journey Chinese reserves the right to review and update these Terms at any time at its discretion. When updated, we will use reasonable efforts to notify you. Any changes take effect immediately upon publication. You are encouraged to keep a copy of these Terms for your records.
(d) We will provide at least 14 days’ notice of any material changes via email and/or prominent notice on the Website. Your continued use of the Website after such notice constitutes acceptance of the revised Terms.

3. Subscription to Use the Services
(a) To access the Online Mandarin School Services, you must first purchase a subscription (Subscription) and pay the applicable fee (Subscription Fee).
(b) It is your responsibility to ensure that the Subscription you select is suitable for your use.
(c) After purchasing, you must register for an account (Account) to access the Services.
(d) During registration, you may be asked to provide personal details such as:

• Preferred username
• Mailing address
• Telephone number
• Password
• Payment information (for purchases)
(e) You warrant that the information you provide is accurate, complete and up to date.
(f) Once registered, you will become a member (“Member”) and gain access to the Services for the duration of your Subscription Period.
(g) You may not use the Services if you are under the legal age to form a binding contract or are prohibited from receiving the Services under applicable law.
4. Your Obligations as a Member

(c) Journey Chinese may vary the Subscription Fee at any time, effective at the end of your current Subscription Period.
6. Refund Policy
(a) Journey Chinese may issue refunds at its discretion if we are unable to continue providing the Services or determine that a refund is reasonable under the circumstances.
(b) Refund requests must be submitted in writing within 7 business days of the event giving rise to the request. Approved refunds will be processed within 14 business days using the original payment method.
(c) These provisions apply in addition to your rights under the Australian Consumer Law.
7. Copyright and Intellectual Property
(a) All content on the Website—including text, graphics, videos, designs, code and interactive elements—is protected by copyright and intellectual property laws.
(b) Unless otherwise indicated, all rights are owned or controlled by Journey Chinese or its contributors.
(c) Journey Chinese grants you a limited, non-exclusive, revocable licence to:
• Use the Website and Services as permitted by these Terms;
• Store or print pages for personal, non-commercial use.
(d) You may not reproduce, republish, distribute or publicly display Website materials without written permission.
(e) Nothing in these Terms transfers ownership of any intellectual property to you.

10. Limitation of Liability
(a) To the maximum extent permitted by law, Journey Chinese’s total liability arising from these Terms or the Services will not exceed the resupply of the Services or the amount you paid in the previous 12 months, whichever is less.
(b) Journey Chinese will not be liable for indirect, consequential or special loss, including loss of profit, goodwill, or data.
11. Competitors
Competitors (those providing similar services for commercial gain) are not permitted to use or access the Website or its materials. Journey Chinese may pursue damages or injunctive relief for any breach.
12. Termination
(a) Either party may terminate these Terms.
(b) You may terminate by providing 14 days’ written notice and closing your account.
(c) Journey Chinese may terminate immediately if you breach the Terms, we are required to do so by law, or continuing to provide the Services is no longer commercially viable.
(d) We may also suspend or cancel your access without notice if your conduct harms our reputation or breaches applicable law.
13. Indemnity
You agree to indemnify and hold harmless Journey Chinese, its employees and licensors against all claims, losses or expenses arising from your breach of these Terms or misuse of the Website.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
15. Severance
If any part of these Terms is found invalid or unenforceable, that part will be severed and the remainder will continue in full force.
