TERMS AND CONDITIONS
WEBSITE & ONLINE MANDARIN SCHOOL
These Terms & Conditions govern your access to and use of Journey Chinese (the “Service”), an online Mandarin school providing courses, tutoring, cultural content and related materials at journeychinese.com.au or school.journeychinese.com.au. The Service is operated by Nicolson Pty Ltd(ABN 93 683 699 416), trading as Journey Chinese (“Journey Chinese”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. Eligibility and accounts
You must be at least 18 years old to create an account. By registering, you confirm that you are over 18 and that the information you provide — including your name, email and payment details — is accurate and kept up to date.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised.
2. Kids zone and supervision of minors
The Service is intended for adult account holders. Some content, including the Kids zone, is designed for children to use under the direct supervision of the adult account holder. We do not create separate child accounts and do not knowingly collect personal information from children.
If you allow a child to use your account, you are responsible for supervising that use and for the child’s compliance with these Terms.
3. Tutoring services and tutor conduct
Journey Chinese offers live online tutoring as part of the Service. Our tutors:
hold a current Queensland Working with Children Check (Blue Card) where required to work with people under 18; and
agree to abide by the Australian Tutoring Association (ATA) Member Code of Conduct, which sets professional, ethical and child-safety standards for tutors.
Live sessions are for your personal learning only. You must not record, reproduce or redistribute any session without our written permission.
4. Acceptable use
You agree to use the Service lawfully and not to:
share, resell or commercially exploit your access or our content;
access the Service through automated means (scraping, bots) except as we expressly permit;
attempt to interfere with, reverse engineer or circumvent the security of the Service; or
use the Service in any way that infringes the rights of others.
5. Payments
Paid courses and subscriptions are billed through Stripe, our third-party payment processor. By making a purchase you agree to Stripe’s terms and to pay all applicable fees. We do not store your full card details.
6. Refunds
Refund requests must be submitted in writing within 7 business days of purchase. Approved refunds are processed within 14 days to the original payment method. Nothing in this clause limits your rights under the Australian Consumer Law (see clause 8).
7. Intellectual property
All content on the Service — including lessons, videos, flashcards, text, graphics and software — is owned by Journey Chinese or its licensors and is protected by law. We grant you a limited, personal, non-transferable licence to access this content for your own learning. You may not copy, distribute, publicly display or create derivative works from it without our written permission.
8. Educational disclaimer
Our courses are aligned to the HSK framework and designed to support your study, but we do not guarantee any particular exam result or learning outcome. Your progress depends on your own effort and circumstances.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under that law. Where we are permitted to limit our liability, our liability is limited (at our option) to resupplying the relevant services or paying the cost of having them resupplied.
10. Limitation of liability
Subject to clause 8, and to the extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the greater of resupply of the relevant services or the amount you paid us in the 12 months before the claim. We are not liable for any indirect, incidental or consequential loss.
11. Termination
You may close your account at any time by giving us 14 days’ written notice. We may suspend or terminate your access immediately if you breach these Terms or where required by law. On termination, your right to access the Service and its content ends.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new “last updated” date. Continued use of the Service after a change means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of Queensland, Australia. You and Journey Chinese submit to the exclusive jurisdiction of the courts of Queensland.
