This Privacy Policy explains how Nicolson Pty Ltd (ABN 93 683 699 416), trading as Journey Chinese ("we", "us"), collects, uses and protects your personal information when you use Journey Chinese — including our websites at journeychinese.com.au and school.journeychinese.com.au and our iOS app (together, the "Service"). We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

1. Information we collect

Information you give us:

  • account details — your name and email address, and your password (stored only in encrypted form)

  • payment details — collected and processed by Stripe, our payment processor. We never see or store your full card number

  • messages you send us, including support requests and study-group communications

  • Profile photo (optional) — if you choose to add a profile picture, we store the image you select or take. You can remove it at any time in Settings

  • marketing preferences.

Information created as you use the Service:

  • learning data — lessons watched and completed, video resume positions, quiz results, flashcard responses and mastery levels, streaks and progress statistics

  • technical data — device type, browser, IP address, and logs generated when you use the Service

  • video viewing data collected by our video host when you play lessons.

2. How we use your information

We use your personal information to:

  • operate your account and deliver the Service, including scheduling tutoring sessions online, or for our online school: saving your progress, streaks and flashcard mastery across devices;

  • process payments, renewals and cancellations;

  • run live study groups, webinars and events you choose to join;

  • respond to your questions and provide support;

  • send you service emails (receipts, renewal notices, important account information) — these are not marketing and you will receive them while you hold an account;

  • send newsletters and marketing emails where you have opted in — you can unsubscribe at any time using the link in any marketing email;

  • improve the Service, diagnose problems and keep it secure; and

  • meet our legal obligations.

3. Who we share it with

We do not sell your personal information. We share it only with the service providers we use to run Journey Chinese, and only as needed.

Some of our providers store or process data on servers located overseas, (e.g. Stripe) including in the United States. Where that happens, we take reasonable steps to ensure your information is handled consistently with the Australian Privacy Principles.

4. How we protect your information

We use organisational and technical measures to protect your personal information, including encryption in transit, encrypted password storage, access controls and row-level security on our databases. No method of transmission or storage is completely secure, but we take reasonable steps to safeguard your data, and we will notify you and the OAIC of any eligible data breach as required by law.

5. Children

The Service is intended for adult account holders. We do not create child accounts and do not knowingly collect personal information from children. Where children use Kids Zone content, they do so under the supervision of the adult account holder, using that adult's account — any learning data generated is recorded against the adult's account.

6. Cookies

We use essential cookies to keep you signed in and make the Service work. Our marketing website also uses the Meta Pixel, an advertising cookie that helps us measure the effectiveness of our advertising on Facebook and Instagram. You can limit ad tracking through your browser settings or your Facebook ad preferences (facebook.com/adpreferences). 

7. How long we keep your information

We keep your information while your account is active. If you cancel, we retain your account and learning data so you can pick up where you left off if you rejoin. You can ask us to delete your account and personal information at any time (see below); we will then delete or de-identify it, except where we are required to keep records (for example, transaction records for tax purposes).

8. Accessing, correcting and deleting your information

You may request access to, or correction of, the personal information we hold about you, or ask us to delete it, by contacting us using the details below. We will respond within a reasonable time (usually within 30 days).

1. Terms

By accessing or using the website at journeychinese.com.au (the “Site”), operated by Nicolson Pty Ltd(ABN 93 683 699 416), trading as Journey Chinese (“Journey Chinese”, “we”, “us”), you agree to be bound by these Terms of Use, all applicable laws and regulations, and acknowledge that you are responsible for compliance with any relevant local laws.

If you do not agree with any of these terms, you are prohibited from using or accessing the Site. The materials on this Site are protected by applicable copyright and trademark laws.

2. Use licence

Permission is granted to temporarily download one copy of the materials (information or software) on the Site for personal, non-commercial and transitory viewing only. This is a licence, not a transfer of ownership, and under this licence you must not:

  • modify or copy the materials;

  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

  • attempt to decompile or reverse engineer any software contained on the Site;

  • remove any copyright or other proprietary notations from the materials; or

  • transfer the materials to another person or “mirror” the materials on any other server.

This licence will automatically terminate if you breach any of these restrictions and may be terminated by Journey Chinese at any time. Upon termination, you must destroy any downloaded materials in your possession, whether in electronic or printed form.

3. Disclaimer

The materials on the Site are provided on an “as-is” basis. To the extent permitted by law, Journey Chinese makes no warranties, expressed or implied, and disclaims all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other rights.

Journey Chinese does not warrant or make any representations about the accuracy, likely results, or reliability of the materials on the Site or on any websites linked to it.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded.

4. Limitations

To the fullest extent permitted by law, and subject to clause 3, in no event shall Journey Chinese or its suppliers be liable for any damages (including, without limitation, damages for loss of data, loss of profit, or business interruption) arising from the use or inability to use the materials on the Site, even if Journey Chinese or an authorised representative has been notified of the possibility of such damages.

5. Accuracy of materials

The materials appearing on the Site could include technical, typographical, or photographic errors. Journey Chinese does not warrant that any of the materials on the Site are accurate, complete, or current, and may make changes to the materials at any time without notice, but does not commit to updating them.

6. Links

Journey Chinese has not reviewed all sites linked to or from this Site and is not responsible for the content of any linked sites. The inclusion of a link does not imply endorsement by Journey Chinese. Use of any linked website is at the user’s own risk.

7. Modifications

Journey Chinese may revise these Terms of Use at any time without prior notice. By continuing to use the Site, you agree to be bound by the then-current version of these Terms of Use.

8. Governing law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland for the resolution of any disputes arising out of or relating to the Site or these Terms.
